1. Acceptance of Terms
Welcome to SCHOLAR-IVA. These Terms of Use ("Terms") govern your access to and use of the SCHOLAR-IVA website, application, and related services (collectively, the "Service"). The Service provides tools for discovering, applying to, managing, awarding, and administering scholarships.
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization (e.g., a school, foundation, or scholarship provider), you represent that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 13 years old to create an account. Users under the age of 18 (or the age of majority in their jurisdiction) may only use the Service with the involvement and consent of a parent or legal guardian, or through an educational institution acting on their behalf.
3. Account Registration
- You must provide accurate, current, and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You must notify us promptly of any unauthorized use of your account.
- SCHOLAR-IVA reserves the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Types of Users
SCHOLAR-IVA serves multiple user roles, including:
- Applicants — individuals searching for and applying to scholarships.
- Scholarship Providers — organizations, institutions, or individuals that create, fund, and administer scholarships through the Service.
- Reviewers/Administrators — individuals authorized by a Scholarship Provider to review applications and make award decisions.
Each role may be subject to additional terms presented within the Service (e.g., a Provider Agreement for organizations posting scholarships).
5. Scholarship Listings and Applications
- Scholarship Providers are solely responsible for the accuracy of their scholarship listings, eligibility criteria, deadlines, award amounts, and selection decisions.
- SCHOLAR-IVA does not guarantee that any scholarship listed on the Service is legitimate, currently open, or will result in an award, and does not participate in or influence individual selection decisions unless explicitly stated.
- Applicants are responsible for the accuracy and completeness of the information and materials they submit.
- Submission of an application does not guarantee review, consideration, or award of any scholarship.
6. Fees
Use of the Service by Applicants is free of charge (easy to find scholarships though) but AI help in the system is subject to subscription as described in the pricing page.
SCHOLAR-IVA never charges Applicants a fee to apply for or be considered for a scholarship. Report any request for payment in connection with a scholarship application to edu@scholar-iva.com.
7. User Content
"User Content" means any information, documents, essays, transcripts, images, or other materials submitted through the Service.
- You retain ownership of your User Content.
- By submitting User Content, you grant SCHOLAR-IVA a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely for the purpose of operating and improving the Service, and to share it with the relevant Scholarship Provider(s) as intended by the application process.
- You represent that you own or have the necessary rights to the User Content you submit, and that it does not infringe any third party's rights.
- SCHOLAR-IVA may remove or refuse to display any User Content that violates these Terms.
8. Acceptable Use
You agree not to:
- Submit false, misleading, or fraudulent information in an application or scholarship listing.
- Use the Service to harass, defame, or discriminate against any person.
- Attempt to gain unauthorized access to any account, system, or network connected to the Service.
- Scrape, data-mine, or use automated means to extract data from the Service without prior written consent.
- Upload viruses, malware, or other harmful code.
- Use the Service for any unlawful purpose or in violation of any applicable regulation, including laws governing financial aid, data privacy, or nonprofit fundraising.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
9. Intellectual Property
The Service, including its design, software, text, graphics, logos, and trademarks (excluding User Content), is owned by SCHOLAR-IVA or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without prior written permission.
10. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect personal information, including any information subject to applicable data protection laws (such as FERPA, GDPR, or CCPA, where applicable). Scholarship Providers accessing Applicant data through the Service agree to use that data solely for legitimate scholarship administration purposes and to comply with applicable data protection obligations.
11. Third-Party Links and Services
The Service may contain links to third-party websites or integrate with third-party services (e.g., payment processors, document verification services). SCHOLAR-IVA is not responsible for the content, policies, or practices of any third party, and your use of such third-party services is at your own risk and subject to their terms.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SCHOLAR-IVA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY SCHOLARSHIP APPLICATION WILL RESULT IN AN AWARD.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCHOLAR-IVA AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SCHOLAR-IVA'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SCHOLAR-IVA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) $50.
14. Indemnification
You agree to indemnify and hold harmless SCHOLAR-IVA and its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your User Content, or your misuse of the Service.
15. Termination
SCHOLAR-IVA may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, SCHOLAR-IVA, or third parties. You may terminate your account at any time by contacting edu@scholar-iva.com.
16. Modifications to the Service and Terms
We may modify or discontinue any part of the Service at any time. We may also update these Terms from time to time; material changes will be communicated via edu@scholar-iva.com, and continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of Texas (United States of America), without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the courts located in Travis County, Texas.
18. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy and any applicable Provider Agreement, constitute the entire agreement between you and SCHOLAR-IVA regarding the Service.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
- No Waiver: SCHOLAR-IVA's failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
- Assignment: You may not assign these Terms without SCHOLAR-IVA's prior written consent; SCHOLAR-IVA may assign these Terms in connection with a merger, acquisition, or sale of assets.
